Personal Data is information that identifies, relates to, describes, is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular individual. The Personal Data we collect depends on how you interact with us, the Sites you use, and the information you provide.

We collect information about you from different sources and in various ways when you use our Sites, including information you provide directly, information collected automatically, information from third-party data sources, and data we infer or generate from other data.

Information you provide directly. We collect Personal Data you provide to us. For example:

• Contact Information and Identifiers. We collect first and last name, online identifiers, account and usernames, aliases, IP address, email addresses, home and postal addresses, telephone numbers, emergency contacts, signatures.
• Demographic Data. We collect age including date of birth, gender, marital status, spouse and dependents.
• Work Permit Status. We collect immigration, residency, and related information.
• Professional and Employment-Related Information. We collect (where each is allowed by applicable law) resumes/CVs, references, recommendations, academic and education background and qualifications, work skills and experience, professional interests, professional certifications and registrations, language capabilities, training courses attended, work and salary history, salary expectation, results of credit history and criminal background checks, results of drug and alcohol testing, health screenings or certifications, and driving and vehicle licensing and history.
• Travel Information. We collect loyalty programs numbers; dates and length of travel; hotel names and locations; and travel routes and departures, stops, and destination points.
• Social Media Data. We collect information relating to public profiles, posts, likes, replies, and what you share with us.  If you are an employee, please reference our Employee Social Media Policy.
• Inferences drawn from any of the information identified in this section. We draw inferences to create a profile reflecting an applicant’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.  We also draw inferences for purposes other than creating a profile, including using automated means to generate information about your likely preferences or other characteristics (“inferences”). For example, we infer your general geographic location (such as city, state, and country) based on your IP address.
• Other Information necessary for a legitimate human resources, business, security, travel, or safety-related purpose.

If you are an employee, we additionally collect the following Personal Data that you provide to us:

• Employment and Performance Information. We collect date of hire, title, transfers and promotions, salary and rewards, training, performance appraisals/assessments, absences and reasons for absences, letters of appreciation and commendation, grievances or disciplinary matters, and resignation or termination of employment.
• Payroll and Tax Information. We collect amounts paid, bonuses paid, banking and other financial institution details, insurance and benefits payments, and reimbursement of business expenses (such as travel).
• Benefits Administration Information. We collect types of benefits used, time off requests (e.g., sick and personal leave, vacation requests) and reasons, retirement account information, and insurance.
• Facial Images and Voice Information. We collect photos, videos, and voice recordings.

Information we collect automatically. When you use our Sites, we and our service providers collect some information automatically. For example:

• Job Posting and Application System Analytics. We collect data related to our job posting and application systems ("Career Site"), including: usernames; passwords; system log data such as IP address; browser type and language; device information; access times; referring website addresses; information collected through web beacons such as cookie IDs; information collected through mobile apps such as mobile device IDs; usage data such as time spent on particular pages; page views; and links clicked.
• Geolocation data. Depending on your device and app settings, we collect geolocation data when you use our apps or online Sites. When you visit our website, we derive your approximate location from the IP address collected.

If you are an employee, we additionally collect the following Personal Data automatically:

• Analytics and Monitoring Data. We collect data related to Worker communications and use of TechnipFMC devices, systems, wi-fi, internet service, internal and external websites, equipment, applications, databases, network resources, and infrastructure, (“TechnipFMC Systems”); and personal devices used to connect to TechnipFMC Systems; including usernames; passwords; system log data such as IP address, browser type and language, device information, access times, and referring website addresses; information collected through web beacons, like cookie IDs information collected through mobile apps, like mobile device IDs; usage data, such as time spent on TechnipFMC Systems, features used and actions taken in TechnipFMC Systems, including page views, links clicked, and documents downloaded; contents, header, metadata, delivery and access information for voice calls, voicemail, emails, chats, messaging, documents, and other communications, data, and files stored or transmitted through TechnipFMC Systems.  Employees should refer to our IT Acceptable Use Policy.
• Location Data. We collect office location, conference room booking locations, travel location information described above, company vehicle movements, movement within a TechnipFMC-managed property to enable real-time directions and information related to TechnipFMC and authorized third party services (e.g., building maps, tech support location, nearby services).
• Goods and Services Data. We collect information about work and services performed, purchased, and/or ordered; sales and manufacturing planning and forecasting; accounting data; and marketing and communications with customers and vendors.
• Other sensor Data. We collect audio, electronic, visual, similar information, such as call and video recordings.

Information we create or generate. We infer new information from other data we collect, including using automated means to generate information about your likely preferences or other characteristics (“inferences”). For example, we infer your general geographic location (such as country) based on your IP address.

Special Categories of Personal Data and Sensitive Information. We collect certain “special categories” or “sensitive” Personal Data where required or permitted by law.  For example:

• Government issued identifiers. We collect social security information, taxpayer identification information, driver’s license, state or national identification card, or passport information.
• Racial or ethnic origin, where such information is required to be collected by law, and where permitted by law, such information supports our Equity & Inclusion programs.
• Religious or philosophical beliefs, where such information is required to be collected by law.
• Trade union or Works Council membership, where such information is required to be collected by law.
• Health Information.

If you are an employee, we also collect the following Special Categories or Sensitive Personal Data:

• Financial Account Credentials. Some employees are issued payment cards or company credit cards.  In those situations, we collect account log-in, financial account numbers, debit or credit card number in combination with a security or access code, password, or credentials that allow access to the account.
• Precise Geolocation.
• Genetic Data.
• Biometric information where used for the purpose of uniquely identifying the employee.
• Information relating to sex life such as information related to reproductive health (as necessary to provide benefits or support, or as otherwise disclosed to you) or sexual orientation.
• Content of non-work related communications governed by our IT Acceptable Use Policy (e.g., email or phone monitoring).

Information we obtain from third-party sources. We also obtain the types of information described above from third parties. These third-party sources include, for example:

• Referees. We may contact the references that you have identified.
• Previous and Current Employers. Where allowed by law, we may verify employment and/or obtain references.
• Educational Institutions. Where allowed by law, we may verify degrees, training, and certifications.
• Service providers. These are third parties that collect or provide data in connection with work they do on our behalf, for example companies provide insurance and benefits, or companies that perform time entry, payroll, and expense reimbursement services.
• Travel partners. We utilize travel agents and portals, car service, and ride share companies and exchange personal data with them.
• Background check services. Where allowed by law, we may use third parties to perform background checks.
• Online Sources. Where allowed by law, we may access personal data from online sources such as social networks and recruiting sites.
• Publicly available sources. Public sources of information such as open government databases.

When you are asked to provide Personal Data, you may decline. You may use web browser or operating system controls to prevent certain types of automatic data collection. If you choose not to provide or allow information that is necessary for certain Sites or features, those Sites or features may not be available or fully functional.

If you disclose any Personal Data relating to other people to us or our service providers in connection with the Sites, you take steps to ensure that you have the permission to do so and to permit us to use the information in accordance with this Notice.

We use the Personal Data we collect for purposes described in this Notice or as otherwise disclosed to you. For example, we use Personal Data we collect for the following purposes:

• Recruitment and Evaluation to enable recruitment and hiring decisions, including: interview travel and expense reimbursement processing; benefits eligibility determination; equal employment opportunity, inclusion and accessibility program management and related compliance, administration and government reporting obligations; and personalization of candidate experience.
• Job Posting and Application System Administration to manage, analyze usage of, and make general improvements to our job posting and application systems ("Career Site"), including managing and protecting against unauthorized access and use of company and candidate data, devices, systems, and infrastructure; to communicate information about the Career Site and changes to our terms and policies.
• Health, Safety, and Environmental Administration to manage, monitor, protect and improve campus, parking, buildings, office space, conference rooms, facilities, catering and café services, including monitoring and administering building occupancy and campus parking and transportation; operating and monitoring physical security systems, such as CCTV, key card entry systems, and guest logs; and emergency notification services.

If you are an employee, we additionally process your Personal Data for the following purposes:

• Human Resources Administration to administer and carry out the working relationship, including: payroll and compensation; career planning and development; training and coaching; performance management and review; employee support services; benefits administration; emergency contact or notification; equal employment opportunity, inclusion, and accessibility programs; legal and policy compliance administration and enforcement, including for the purposes of anti-discrimination laws and government reporting obligations; disciplinary matters and investigations; and personalization of employee experience.
• Information Technology Administration to manage, monitor, protect and improve TechnipFMC systems, assets and resources, including: managing and protecting unauthorized access and use of company, employee and customer data, devices, systems, and infrastructure; and measuring, analyzing our systems, assets and resources for improvement and efficiency.
• Operations Efficiency to manage and improve employee workplace and efficiency, including supporting communication, collaboration, and general improvements to products, services, and technology.
• Sales and Services to our Customers to provide goods and services to our customers, procure goods and services from vendors, and to support such with physical and virtual meetings, travel, and research, including general product and services development.
• Governance and Compliance with Applicable Law to administer and enforce our governance and compliance programs, including monitoring access and use of company systems, and conducting compliance audits and reviews.

We combine Personal Data we collect from different sources for the above purposes: (1) in order to manage our contractual relationship with you; (2) to comply with our legal obligations; (3) because we have a legitimate interest; and/or (4) upon your consent, especially where consent is required by applicable law. Our legitimate interests include securing the Sites and the TechnipFMC Systems from unauthorized use, analyzing and improving the efficiency of the Sites, the TechnipFMC Systems, and protecting our intellectual property.

Where collection, use, or disclosure of Personal Data is based on your consent, you may withdraw your consent at any time to the extent permitted by Law. Withdrawal of consent will not affect the lawfulness of any processing that occurs before consent is withdrawn. Failure to provide necessary Personal Data may disqualify a candidate or employee for employment or restrict participation in certain plans or programs.

We disclose Personal Data with your consent or as we determine necessary in furtherance of the purposes described above. Third parties with whom we may disclose your Personal Data to include: 

• Public Information. We may provide features or services that permit Applicants and Employees to publicly display and disclose certain Personal Data, such as your name or username, profile or directory information, or other Personal Data that you choose to disclose.
• Affiliates. We enable access to Personal Data across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our Sites, the TechnipFMC Systems, and operate our business. TechnipFMC plc is the party responsible for the management of this jointly used Personal Data.
• Service providers. We provide Personal Data to vendors or agents working on our behalf for the purposes described in this Notice. For example, companies we’ve hired to provide website hosting, data analysis, information technology and related infrastructure provision, email delivery, auditing, customer service support, or to assist in protecting and securing our systems and services may need access to Personal Data to provide those functions.  This also includes companies we’ve hired to provide recruiting assistance, website hosting and operations, background check processing, administration of certain HR systems, management of interview and assessment center services, assistance with assessment of suitability for roles, administrative services, and to protect and secure our systems and service.
• Independent Third Parties. We share personal information with independent third parties; for example: benefits partners to facilitate benefits administration (e.g., health and insurance providers) and third-party providers of products and services (e.g., travel agents, ride share services). To the extent that we provide Personal Data to such third parties, that Personal Data is governed by their privacy notices.
• Corporate transactions. We may disclose Personal Data as part of a corporate transaction or proceeding such as a reorganization, merger, financing, acquisition, bankruptcy, dissolution, or a transfer, divestiture, or sale of all or a portion of our business, assets, or stock. Such third parties may include, for example, an acquiring entity and its advisors.
• Legal and law enforcement. We will access, disclose, and preserve Personal Data when we believe that doing so is necessary to comply with applicable law or respond to valid legal process, including from law enforcement or other government. These can include authorities outside your country of residence.
• Security, safety, and protecting rights. We will disclose Personal Data if we believe it is necessary to:
  • protect our customers and others, for example to prevent spam or attempts to commit fraud, or to help prevent the loss of life or serious injury of anyone;
  • operate and maintain the security of our Sites or the TechnipFMC Systems, including to prevent or stop an attack on our computer systems or networks; or
  • protect the rights or property of ourselves or others, including enforcing our agreements, terms and conditions, and policies.

If you are an Employee, your Personal Information may also be shared with other TechnipFMC employees, such as your managers and their designees, personnel in HR, IT, Compliance, Legal, Finance and Accounting and Internal Audit. Further, your work contact information (including job title, manager, and work location) may be listed in internal company directories.  Finally, we share personal information with works councils and trade unions as required by our contractual relationship with those entities.

Third-party analytics and advertising companies also collect Personal Data through our website and apps including identifiers and device information (such as cookie IDs, device IDs, and IP address), geolocation data, usage data, and inferences based on and associated with that data, as described in our “Cookies, Mobile IDs, and Other Technologies” notice.

Finally, we may disclose aggregated or de-identified information in accordance with applicable law.

Currently, we primarily use data centers in the United States, Singapore, Brazil and Norway.  Our storage locations are chosen to promote operational efficiency and to improve performance. We take steps with the intent of processing and protecting as described in this Notice wherever the data are located.

The Personal Data we collect may also be stored and processed in your country or region, or in any other country where we or our affiliates, subsidiaries, or service providers process data. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Data.

The Career Site allows you to apply for jobs worldwide as a benefit of TechnipFMC’s centralized global recruitment function.  The Career Site is operated from the United States, but your information may be transferred to TechnipFMC affiliates and potential employers in other countries.

Location of Processing European Personal Data. We transfer Personal Data from the European Economic Area (EEA), United Kingdom (UK), and Switzerland to other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. When we do so, we use legal mechanisms, including contracts, to help ensure your rights and protections.

We are subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission.

If you are an employee, we may be obligated to share your Personal Data with certain customers and/or vendors in connection with signed contracts to provide or obtain goods and services.  For example, a customer may require identifying information about you before you are allowed on a customer worksite, or a bank we do business with may require certain Personal Data about you if you are a signatory on the account.  If you do not allow us to share required Personal Data with our customers and vendors, you may not be allowed to work on those projects and/or your job duties may be curtailed.

We retain Personal Data for as long as necessary to evaluate your application for employment, and if hired, for the duration of your employment with us.  We additionally retain some Personal Data to comply with our legal obligations, resolve disputes, enforce our agreements, and other legitimate and lawful business purposes. Because these needs can vary for different data types, actual retention periods can vary significantly based on criteria such as the duration of employment, the duration of any ongoing relationship with you or your household, any legal obligation to which we are subject, and as advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).

We provide a variety of ways for you to control the Personal Data we hold about you, including choices about how we use that data. In some jurisdictions, these controls and choices may be enforceable as rights under applicable law.

Data Integrity. We endeavor to use Personal Information that is up-to-date and accurate. If we are made aware that the Personal Information that we maintain is inaccurate, we take reasonable measures to rectify the data.

Access, portability, correction, and deletion. As an Applicant, you may access, correct, or delete Personal Data about you that we hold by logging into the Career Site.  If you are an Employee and have any questions or concerns about how we process Personal Data, please contact your local Human Resources Representative or contact our Privacy personal by using the contact methods described in the Who We Are section of this Notice.  In some countries (such the EEA), Employees have additional privacy rights. For example, in the EEA, Employees may inquire about the Personal Information we maintain about them, be provided with a copy of such Personal Information, request that the Personal Information be corrected or amended where it is inaccurate or incomplete, to object to certain processing, or to request erasure under certain conditions, subject to any legal exceptions to such rights.

If you are unable to access, copy, correct, or delete certain Personal Data we have via the means described above, you can send us a request by using contact methods described in the Who We Are section of this Notice. For your protection, we may only implement requests with respect to the Personal Data associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable. Please note that we may need to retain certain information for record-keeping purposes.

Communications preferences. You can choose whether to receive optional communications from us by email, SMS, and telephone related to new jobs or roles that become available.  If you receive these optional email or SMS messages from us and would like to stop, you can do so by following the directions in that message or by contacting us as described in the Who We Are section of this Notice. If you receive a call from us related to new jobs or roles that become available and no longer wish to receive such calls, you can ask to be placed on our do-not-call list. These choices do not apply to certain informational communications including communications about an existing application with us.

Data sales. Some privacy laws define “sale” broadly to include some the disclosures described in the Our Disclosure of Personal Data section of this Notice and in our “Cookies, Mobile IDs, and Other Technologies” notice. To opt-out from such data “sales,” use the “Do Not Sell or Share My Personal Information” link in the footer of the website, enable a Global Privacy Control in your browser, email us using the contact information at the bottom of this Notice, or use other controls described in this section of this Notice.

Except for the automated controls described in our “Cookies, Mobile IDs, and Other Technologies” notice, if you send us a request to exercise your rights or these choices, to the extent permitted by applicable law, we may decline requests in certain cases. For example, we may decline requests where granting the request would be prohibited by law, could adversely affect the privacy or other rights of another person, would reveal a trade secret or other confidential information, or would interfere with a legal or business obligation that requires retention or use of the data. Further, we may decline a request where we are unable to authenticate you as the person to whom the data relates, the request is unreasonable or excessive, or where otherwise permitted by applicable law. If you receive a response from us informing you that we have declined your request, in whole or in part, you may appeal that decision, in some cases, by submitting your appeal to our privacy office using the contact methods described in the Who We Are section of this Notice.

If the processing of Personal Data about you is subject to European Union data protection law, you have certain rights with respect to that data:

• You can request access to, and rectification or erasure of, Personal Data.
• If any automated processing of Personal Data is based on your consent or a contract with you, you have a right to transfer or receive a copy of the Personal Data in a usable and portable format.
• If the processing of Personal Data is based on your consent, you can withdraw consent at any time for future processing.
• You can object to, or obtain a restriction of, the processing of Personal Data under certain circumstances.
• For residents of France, you can send us specific instructions regarding the use of your data after your death.

To make such requests, or to contact our Data Protection Officer, please use the contact information at the bottom of this Notice. When we are processing data on behalf of another party that is the “data controller,” you should direct your request to that party. You also have the right to lodge a complaint with a supervisory authority for your country or region, but we encourage you to first contact us with any questions or concerns.

If you are a California resident and the processing of personal data about you is subject to the California Consumer Privacy Act (“CCPA”), you have certain rights with respect to that information. This California Privacy Rights section does not apply to our job applicants, employees, contractors, owners, directors, or officers where the personal data we collect about those individuals relates to their current, former, or potential role with us. If you are applying for a job at TechnipFMC, our Global Applicant Privacy Notice applies.

Notice at Collection. At or before the time of collection, you have a right to receive notice of our practices, including the categories of personal data and sensitive personal data to be collected, the purposes for which such information is collected or used, whether such information is sold or shared, and how long such information is retained. You can find those details in this Notice above.

Right to Know. You have a right to request that we disclose to you the personal data we have collected about you. You also have a right to request additional information about our collection, use, disclosure, or sale of such personal data. Note that we have provided much of this information in this Notice. Rights to Request Correction or Deletion. You also have rights to request that we correct inaccurate personal data and that we delete personal data under certain circumstances, subject to a number of exceptions. Right to Opt-Out / “Do Not Sell or Share My Personal Information”. You have a right to opt-out from future “sales” or “sharing” of personal data as those terms are defined by the CCPA. Note that the CCPA defines “sell,” “share,” and “personal data” very broadly, and some of our data sharing described in this Notice may be considered a “sale” or “sharing” under those definitions. In particular, we let advertising and analytics providers collect identifiers (IP addresses, cookie IDs, and mobile IDs), activity data (browsing, clicks, app usage), device data, and geolocation data through our sites and apps when you use our online Sites, but do not “sell” or “share" any other types of personal data. If you do not wish for us or our partners to “sell” or “share” personal data relating to your visits to our sites for advertising purposes, you can make your request by using the Cookie setting link in the footer of this website, using a Global Privacy Control, emailing us using the contact information at the bottom of this Notice, or using other controls described in the Your Rights and Control of Personal Data section of this Notice. If you opt-out using these choices, we will not share or make available such personal data in ways that are considered a “sale” or “sharing” under the CCPA. However, we will continue to make available to our partners (acting as our service providers) some personal data to help us perform advertising-related functions. Further, using these choices will not opt you out of the use of previously “sold” or “shared” personal data or stop all interest-based advertising.

We do not knowingly sell or share the personal data of minors under 16 years of age.

Right to Limit Use and Disclosure of Sensitive Personal Data. You have a right to limit our use of sensitive personal data for any purposes other than to provide the Sites or goods you request or as otherwise permitted by law. Note that we do not use sensitive personal data for any such additional purposes.

You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under the CCPA. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.

If you are an authorized agent and want to make a request on behalf of a California resident, you may use the submission methods noted above. As part of our verification process, we may request that you provide the following, as applicable:

• Proof of your registration with the California Secretary of State to conduct business in California
• A power of attorney from the California resident pursuant to Probate Code sections 4000-4465
• Written permission that the California resident has authorized you to make a request on the resident’s behalf. This permission must be signed (via physical or e-signature) by the California resident.

Further, to provide, correct, or delete specific pieces of personal data we will need to verify your identity to the degree of certainty required by law. We will verify your request by asking you to send it from the email address associated with your account or requiring you to provide information necessary to verify your account. We may ask you to confirm your request before we delete your personal data.

Finally, you have a right to not be discriminated against for exercising these rights set out in the CCPA.

Additionally, under California Civil Code section 1798.83, also known as the “Shine the Light” law, California residents who have provided personal data to a business with which the individual has established a business relationship for personal, family, or household purposes (“California Customers”) may request information about whether the business has disclosed personal data to any third parties for the third parties’ direct marketing purposes.

Please be aware that we do not disclose personal information to any third parties for their direct marketing purposes as defined by this law.

We take reasonable and appropriate steps to help protect Personal Data from unauthorized access, use, disclosure, alteration, and destruction.

To help us protect Personal Data on the Sites (including the Career Site), we request that you use a strong password and never share your password with anyone or use the same password with other sites or accounts. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the Who We Are section of this Notice.  

Employees are subject to our various Information Security policies and Acceptable Use policies.

We do not use automated decision making on any information which you do not provide, and we do not perform any automated decision making based on any special categories of Personal Data.

We may use automated decision making based on the information you provide to meet our legal obligations.  For example, we may be restricted by law from employing individuals younger than a certain age and may use automated decision making to screen your application based on the age you provide us.

We may also use algorithms to analyze the information you provide in order to assess your suitability for a role based upon a role requirement or description.  For example, if a role requires a specific certification, we may score applicants based on their possession of such certification.  Applicant evaluation decisions in these instances are never based solely on algorithmic scoring, and an applicant may still be considered for a role even if the algorithm results in the applicant being scored poorly for a particular role requirement.  For example, we may decide to hire an applicant for a particular role notwithstanding their algorithmic score for work permit status provided the applicant can obtain the proper work permit status prior to employment.

We will update this Notice when necessary to reflect changes in our Sites, how we use Personal Data, or applicable law. When we post changes to the Notice, we will revise the "Last Updated" date at the top of the Notice and any changes will become effective when we post the revised Notice on the Sites. If we make material changes to the Notice, we will provide notice or obtain consent regarding such changes as may be required by law.
