TechnipFMC Global Applicant Privacy Notice

This TechnipFMC Global Applicant Privacy Notice (“Notice”) explains our collection, use, and disclosure of Personal Data (defined below) relating to applicants and prospective employees and workers (“Applicant(s)” or “you”) who submit an application for employment through the Careers Site. The Careers Site is not intended for minors under the age of 18, or for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation.

This Notice only applies to TechnipFMC's recruitment activities. Personal Data submitted elsewhere on TechnipFMC’s and its affiliates’ websites will be used in accordance with our general Website Privacy Notice.

This Notice applies to TechnipFMC plc and to our controlled affiliates and subsidiaries (“[COMPANY]”, “we”, “our”, or “us”). A TechnipFMC entity may collect or process Personal Data on behalf of another TechnipFMC entity.

This Notice is from the data controller responsible for your application and recruitment, normally the TechnipFMC company to whom you are applying for a position, or which is offering the role for which you have applied, and any other company in the TechnipFMC corporate group (“Group”) responsible for decision making on your application and recruitment, including the Group parent company TechnipFMC plc, located at Hadrian House, Wincomblee Road, Newcastle Upon Tyne, United Kingdom, NE6 3PL.

This Notice is not intended to create any rights beyond those that exist by virtue of applicable privacy and data protection law.

PERSONAL DATA WE COLLECT

Personal Data is information that identifies, relates to, describes, is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular Applicant or (where applicable) Applicant’s household.

We collect Personal Data about you from different sources and in various ways during your application and candidacy, including information you provide directly, information collected automatically, information received from third-party data sources, and data we infer or generate from other data. The categories (and examples) of Personal Data we collect and process about you include:

  • Contact information and identifiers, such as first and last name, online identifiers, account and usernames, aliases, IP addresses, email addresses, home and postal addresses, telephone numbers, signatures, and other identifiers described in the Sensitive Personal Data category below
  • Professional and employment-related information, such as:
    • Demographic data, some of which may be protected classifications under California and U.S. federal law, such as age including date of birth, gender, marital status, spouse and dependents, and certain Sensitive Personal Data categories, described below
    • Work permit status, such as immigration, residency, and related information
    • Professional and background information such as resumes/CVs; references; recommendations; academic and education background and qualifications; work skills and experience; professional certifications, licenses, permits, and registrations; language capabilities; training courses attended; work and salary history; information provided for and results of background checks, which may include credit history and criminal background checks, where permitted by applicable law; results of drug and alcohol testing, health screenings or certifications; driving and vehicle licensing and history; and inferences from other data we collect for purposes other than creating a profile, including using automated means to generate information about your likely preferences or other characteristics (“inferences”)
    • Benefits eligibility information, such as information for determining benefits and cost estimation, (which may require information about gender, age, birthdate, marital status, and personal information of spouse and dependents)
    • Travel information, such as loyalty programs numbers; dates and length of travel; hotel names and locations; and travel routes and departures, stops, and destination points
    • Personal vehicle information, such as license plate number, color, year, make, and model
    • Social media data, such as public profiles, posts, likes, and replies.
    • Inferences from other data we collect for purposes other than creating a profile, including using automated means to generate information about your likely preferences or other characteristics (“inferences”). For example, we infer your general geographic location (such as city, state, and country) based on your IP address.
  • Education Information (U.S. Applicants, only), that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99)
  • Audio, electronic, visual, thermal, olfactory, or similar information, including facial images and voice information, such as photos, videos, CCTV, voice recordings, and sensor data.
  • Geolocation and Location data, such as approximate location based on an IP address or device identifier, travel location information described above
  • Internet or other electronic network activity, including as related to Applicant communications and use of our devices, systems, wi-fi, internet service, internal and external websites, equipment, applications, databases, network resources, and infrastructure (“Systems”); and personal devices used to connect to our Systems; including usernames; passwords; system log data such as IP address, browser type, and language, device information, access times, and referring website addresses; information collected through web beacons, like cookie IDs; information collected through mobile apps, like mobile device IDs; usage data, such as time spent on our Systems, features used, and actions taken in our Systems, including page views, links clicked, and documents downloaded; contents, header, metadata, delivery and access information for voice calls, voicemail, emails, chats, messaging, documents, and other communications, data, and files stored or transmitted through Company Systems.   • Inferences drawn from any of the information identified in this section to create a profile reflecting our Applicant’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
  • Other information necessary for a legitimate human resources, business, security, or safety-related purpose.

SENSITIVE PERSONAL DATA

In certain cases we will ask questions about race/ethnic origin, gender, and disability of our applicants for monitoring equal opportunity. We can also inquire about criminal records. We will do so only where permitted by applicable law.

We collect certain “sensitive” or “special categories” of Personal Data (“Sensitive Personal Data”). To support our legal and business activities, and as permitted by law, we may collect Sensitive Personal Data as part of our employment relationship with you. Examples of Sensitive Personal Data that we collect include:

  • Government-issued identifiers, such as social security information, driver’s license, state identification card, or passport number
  • Sensitive demographic information such as racial or ethnic origin, or union membership
  • Health information

COOKIES, MOBILE IDs, AND SIMILAR TECHNOLOGIES

We use cookies, web beacons, mobile analytics and advertising IDs, and similar technologies to operate our websites, applications, and online services accessible to you in the context of our employment relationship. Please see our “Cookie Policy” to understand how we use Personal Data collected via these technologies.

How do we and our providers use cookies and similar technologies?

We, and our analytics and advertising providers, use these technologies in our websites, apps, and online services to collect Personal Data when you access and use our services, including Personal Data about your online activities over time and across different websites or online services. This data is used to store your preferences and settings, enable you to sign in, analyze how our websites, apps, and services perform, track your interaction with the site or app, develop inferences, combat fraud, and fulfill other legitimate purposes. We and/or our providers also share the data we collect or infer with other providers for these purposes as described in the Disclosure of Personal Data section of this Notice.

USE OF PERSONAL INFORMATION

We use Personal Data to administer and carry out the recruitment and hiring process, including for human resources and our operational, business, safety, and security purposes including as described in this Notice and below. Providing certain Personal Data to us through the Careers Site is voluntary. However, if you do not provide Personal Data that is necessary for us to handle your application, TechnipFMC may be unable to consider your application. Our application form on the Careers Site clearly indicates which Personal Data is required and which is voluntary.

Finally, we may use aggregated or de-identified information in accordance with applicable law. For example, the data can be used for statistical analysis and administration, including analysis of trends, carrying out actuarial work, tailoring products and services, risk assessment and analysis of costs and charges in relation to our products and services.

If you become a TechnipFMC employee or worker, Personal Data we collected as part of the application and hiring process will become part of your employment file and will be used and disclosed in accordance with our Worker Personal Information Notice.

We provide personal information to vendors or agents working on our behalf for the purposes described in this Notice. CHOICE AND CONTROL OF PERSONAL INFORMATION

We provide a variety of ways for you to control the Personal Data we hold about you, including choices about how we use that data. In some jurisdictions, these controls and choices may be enforceable as rights under applicable law.

Communications preferences. You can choose whether to receive optional communications from us by email, SMS, [physical mail], and telephone related to new jobs or roles that become available. If you receive these optional email or SMS messages from us and would like to stop, you can do so by following the directions in that message or by contacting us as described in the Contact Us section of this Notice. If you receive a call from us related to new jobs or roles that become available, and no longer wish to receive such calls, you can ask to be placed on our do-not-call list.]. These choices do not apply to certain informational communications, including communications about an existing application with us.

Targeted advertising. You have several options to opt-out of or otherwise, control targeted advertising. Review our Cookie Notice for more information.

As described in our Cookie Notice we engage analytics and advertising providers to collect Personal Data through our website including identifiers and device information, geolocation data, usage data, and inferences based on and associated with that data. These providers may combine this data across multiple sites to improve analytics for their own purpose and others.

Some of the data disclosures to these providers may be considered a “sale” or “sharing” of Personal Data as defined under the laws of California and other U.S. states. Please see the Personal Data Rights section of this Notice for more details.

Please note that our Careers Site may include integrations, references, or links to services provided by providers whose privacy practices differ from ours. If you provide Personal Data via these integrations, references, or links, or allow us to disclose Personal Data to them, that information is governed by their privacy notices.

NOTICE AND LAWFUL BASIS

We provide you with notice about the Personal Data we collect, how it will be used, and with whom we disclose Personal Data, such as through this Notice and notices at collection, and our Website Privacy Notice.

We collect, use, and disclose Personal Data as necessary to carry out the hiring and recruiting relationship with you and/or on the basis of our legitimate interests, as described above. Where required by law, we will provide additional notice and/or seek consent for any collection, use, or disclosure of Personal Data for purposes beyond that which is necessary for our hiring or recruiting requirements or comply with legal requirements. Where collection, use, or disclosure of Personal Data is based on your consent, you may withdraw your consent at any time to the extent permitted by law. Failure to provide necessary Personal Data may disqualify you from employment consideration.

DATA RETENTION

We retain Personal Data in accordance with our obligations under applicable labor and employment laws and as necessary to administer and carry out the employment relationship and our post-employment obligations. The criteria used to determine our retention periods are: (i) the duration of the application process; (ii) as long as we have an ongoing relationship with you; (iii) as required by a legal obligation to which we are subject; (iv) as advisable in light of our legal position (such as in regard of applicable statutes of limitations, litigation, or regulatory investigations).

We also retain your Personal Data for the purpose of considering whether your skills are suitable for other opportunities. If you do not wish us to do this, please click here. We remove Personal Data for inactive accounts from our database, subject to any applicable legal or regulatory obligations. Furthermore, TechnipFMC can delete Personal Data about you, including your CV/résumé, from our database at any time and without providing any reason. Therefore, please retain your own copy of the Personal Data provided to us. If your application is unsuccessful, we retain your Personal Data (depending on your jurisdiction and its local legal requirements) for up to two years in case of queries from you or to deal with follow-on issues (or for such longer period as is necessary to properly deal with such queries or issues).

DATA INTEGRITY

We endeavor to use Personal Data that is up-to-date and accurate. If we are made aware that the Personal Data that we maintain is inaccurate, we take reasonable measures to rectify the data.

DATA TRANSFER AND LOCATION

Personal Data we collect may be stored and processed in the United States or any other country in which we or our affiliates, subsidiaries, or agents maintain facilities, some of which have not been found by the European Commission to have an adequate level of data protection. When we transfer Personal Data to a country outside the EEA, UK, or Switzerland, we protect that information in accordance with applicable law, such as the General Data Protection Regulation (GDPR) and applicable EEA, UK, and Swiss data protection laws. As for transfers to other countries, we have put in place a variety of adequate measures, such as, but not limited to, standard contractual clauses adopted by the European Commission, to protect your Personal Data.

The Careers Site allows you to apply for jobs worldwide, as a benefit of TechnipFMC’s centralized global recruitment function. This Careers Site is operated from the United

States, but your information may be transferred to TechnipFMC Affiliates and potential employers in other countries.

If you have a question or a complaint related to our processing of Personal Data, you may contact us as indicated in the Contact Us section of this Notice. For complaints that cannot be resolved directly we will cooperate with the relevant Data Protection Authority to resolve any issues.

PERSONAL INFORMATION RIGHTS

Under certain local, state, federal, and international laws, Applicants have certain privacy and data protection rights related to the processing of their Personal Data. Please review the relevant information in this section. Use the contact information in the Contact Us section of this Notice to exercise one or more of these rights. In your request, please make clear what Personal Data you would like to access or have changed, whether you would like to have Personal Data that you have provided to us suppressed from our database or otherwise let us know what limitations you would like to put on our use of your Personal Data. Please note that certain Personal Data may be exempt from such requests pursuant to applicable data protection laws or other laws and regulations. Further, to provide, correct, or delete specific pieces of Personal Data, we will need to verify your identity to the degree of certainty required by law. We will verify a request by asking you to send it from the email address associated with your application or by providing the information reasonably necessary to verify your identity.

If you register on the Careers Site, you may access, review, and change your Personal Data stored therein by logging into the Careers Site and updating your account information. The updated profile will be used as the default the next time you apply for a job using your account online. To change Personal Data that you have already submitted for consideration for a specific position, please update your profile and resubmit your application for that position. We encourage you to promptly update your Personal Data if it changes or is inaccurate.

European Economic Area, UK, and Swiss Applicant Data Protection Rights

If our processing of Personal Data about you is subject to European Union, UK, or Swiss data protection law, you have certain rights with respect to that information:

  • You can request access to and rectification or erasure of, Personal Data;
  • If any automated processing of Personal Data is based on your consent or a contract with you, you have a right to transfer or receive a copy of the Personal Data in a usable and portable format;
  • If the processing of Personal Data is based on your consent, you can withdraw consent at any time for future processing;
  • You can object to, or obtain a restriction of, the processing of Personal Data under certain circumstances; and
  • For residents of France, you can send us specific instructions regarding using your data after your death.

California Applicant Privacy Rights

The California Consumer Privacy Act of 2018, Civil Code section 1798.100 et seq as amended, including by the California Privacy Rights Act of 2021 (“CCPA”), provides California Applicants with the following rights concerning their Personal Data:

Right to Know. You have a right to request that we disclose the Personal Data we have collected about you. You also have a right to request additional information about our collection, use, disclosure, sale, or sharing of Personal Data. Note that we have provided much of this information in this Notice.

Right to Request Correction. You have the right to request the correction of inaccurate Personal Data.

Right to Request Deletion. You also have a right to request that we delete Personal Data under certain circumstances, subject to lawful exceptions.

Right to Opt-Out. You have a right to opt-out from the “sale” or “sharing” of Personal Data, each of which is defined under CCPA. Note that the CCPA defines “sell,” “share,” and “Personal Data” (described as “Personal Information” in CCPA) very broadly, and some of our data disclosures described in this Notice may be considered a “sale” or “sharing” of Personal Data under those definitions. In particular, we let advertising and analytics providers collect IP addresses, cookie IDs, and mobile IDs through our sites and apps when you use our applicant website or portal, but we do not “sell” or “share” any other types of Personal Data. Please review the Choice and Control of Personal Data section of this Notice for more information on how to opt-out.

As the Careers Site is not intended for minors under the age of 18, we do not knowingly sell the Personal Data of minors under 16 years of age.

Right to Limit Use and Disclosure of Sensitive Personal Data.
